Zach Tomaselli, the third man to come forward accusing former Syracuse University assistant basketball coach Bernie Fine of sexual abuse, will hold a news conference in Pittsburgh Thursday, where he's expected to announce that he is filing a civil lawsuit against Fine.
Tomaselli says that he took a bus from Syracuse to Pittsburgh in January of 2002 to watch Syracuse's game against Pittsburgh. Tomaselli says he stayed in Bernie Fine's hotel room, where he says he was sexually abused.
Tomaselli's credibility has been called into question by both Tomaselli's father and Onondaga County District Attorney Bill Fitzpatrick.
Fred Tomaselli has said that his son is lying and that he never took a trip to Pittsburgh.
During a news conference on Wednesday, Fitzpatrick said that his office has exculpatory evidence that he will be turning over to Bernie Fine's attorneys. Exculpatory evidence is evidence that can help the defendant.
Fitzpatrick says that evidence includes travel and hotel records from Syracuse University, as well as attendance records from the Copenhagen School District, where Thomaselli attended school, from the dates in question.
Fitzpatrick would not confirm whether those attendance records indicated that Tomaselli was in class and not with the Syracuse basketball team.
Follwing Fitzpatrick's news conference, Tomaselli told the Syracuse Post-Standard that it was "highly inppropriate" for Fitzpatrick to comment on his allegations, since his office is not investigating them.
Tomaselli is facing charges in Maine that he sexually abused a 14 year old boy. He has said that he will plead guilty to those charges.
